This reads like a theoretical case of escalation, however one should not be surprised that such fine-print is actually enforced.
Can it be concluded that this is part of KlearGear's business model? If it wasn't wouldn't they try to make it very clear that any actions that negatively impact KlearGear are not permitted and penalties strictly enforced?
